Fascinating review. I am reminded of the old admonition to the jury by a lawyer who catches a witness in a big lie- "If they lied about this, what else might they be lying about?" So let's start with the fact that practically the first thing the customer told me about her HOA's design review committee was that it was headed by a woman who for many years had been her arch enemy. Only the previous year her front yard landscape design was turned down because the common name of a plant she included was on the list of banned plants and was spuriously deemed to be in that category. What I specifically told the customer regarding the use of trellises along the property line was that I had gotten them approved in Celebration, Keene's Point, Baldwin Park, City of Winter Park, among many others, and that in fact, we had never had them turned down. I would never be so presumptious as to say I definitively know what any HOA design committee might do since these bodies are notorious for their overall lack of common sense or reason. What makes a difference is having a professional design person make a presentation to them since these groups- who frequently make mincemeat out of the average homeowner, generally demur to someone they know has them completely trumped in the technical knowledge department. I offered three separate times to attend the meeting and was assured that it wasn't necessary. Regarding the plants- what I told her was that the plants we specified are on almost every communities approved list and I could certainly make the argument as to their appropriateness if needed. She fails to mention that in fact (I have an email from her confirming this) that all the plants were approved! So there you have it. She leaves out the whole arch enemy dynamic, misrepresents my statements about the approval of the trellises, doesn't mention my rebuffed offer to attend the presentation and also fails to mention that all the plants were approved. I also offered to draw up an amended plan as soon as she told me there had been a problem. Finally, I got my only decent grade from her of "B" for punctuality. Let's see- I got a call from her on Wednesday, met with her and her husband on Friday and gave them a complete color plot plan, specifications and presentation on Tuesday morning so she could submit for the Wednesday meeting. I'm just trying to figure, what would have earned an "A?" On the other hand, it's foolish of me to expect her to be fair about anything.
