As stated above, the company has continually refused to comply with our agreement and has kept our two units.
Description of Work: We returned two tankless water heater s to a company last January under their RMA number and with the understanding that there would be a 30% restocking fee. We have contacted them several times with no resolution and no check. We finally just received a letter stating that they told us they would only give us $100 credit for each unit toward the purchase of new ones. We paid $1,596 lea 20% discount when we purchased them. We had to spend around $150 to send the units to them. How do I file a complaint so that maybe with Angie's List clout, we can get a fair resolution? They agreed to pay us $851.62 for the returned units.

Your client purchased two tankless water heaters from SETS Systems, Inc. in August of 2007 and allege that in January 2009 SETS Systems Inc. approved a return of the equipment and a refund of the purchase price, less a 30% restocking fee. Upon investigation of this matter, it appears that in January 2009 your clients contacted Hubbell (not SETS Systems) indicating that they intended to return "new" Hubbell tankless heaters, at which time they were verbally provided information regarding Hubbell's return policy (i.e., the aforementioned refund less stocking fee). Upon receipt of the units at its Stratford office, Hubbell discovered that that the heaters were, in fact, SETS Systems heaters and not Hubbell heaters. While the units may be "new" in the sense that they have never been used, they are, as you point out, SETS Systems heater purchased from SETS Systems Inc. by your clients in 2007. This being the case, Hubbell provided your clients with offer it has made to similarly situated SETS owners -- a $100 credit against the purchase of a Hubbell heater for each SETS heater traded in. On June 26, 2008, Hubbell acquired the assets of Space Energy Time Savings (S.E.T.S) Inc. ("SETS"). However, Hubbell did not assume any of the liabilities of SETS (including warranty and return claims). Notice of such was provided on the SETS website and has been available on the Hubbell website since June of 2008. Hubbell bears no responsibility for claims made by owners of SETS Systems heaters. However, in its transition of the SETS brand into the Hubbell family of products, it has consistently offered SETS customers a discount towards the purchase of a Hubbell unit. Your clients have been provided an offer in keeping with this approach. To be clear, there is no contractual relationship between Hubbell and your clients. Contrary to your member's claim, there was no "agreement to make a cash refund." Rather, in January 2009, the Hubbell representative recited the return policy for a new Hubbell heater with the understanding that he was speaking with a Hubbell customer who was seeking to return a new Hubbell heater. Surely, you cannot be suggesting that Hubbell is legally bound to apply its manufacturer's guaranty to a product (i) that it did not manufacture and (ii) for which is has been expressly excluded from liability by the manufacturer, because your clients (whether intentionally or not) mistakenly identified their SETS Systems heaters as a Hubbell heaters or mistakenly believed they were speaking to SETS Systems (as indicated in your letter). Your contention that your clients have a viable claim in contract is supported neither by law nor fact. As indicated above and previously by Hubbell representatives, Hubbell would like to do business with your clients and is willing to offer a $100 credit towards the purchase of each new Hubbell heater, should your clients so desire. Otherwise, Hubbell is happy to return the units to your clients (at Hubbell's expense). Hubbell cannot "refund" your clients' money. Hubbell never received it.

Once you buy something from them, they have a guarantee for life on the products. The only thing is that every time you need them to come over, they charge 100 dollars, which is a little high. I think they are great though.
Description of Work: They repaired the hot water heater for the shower because there wasn't a way to regulate it or balance the cold and hot water. They did replace a part but I just can't remember what that was.
