We had paid our deposit of $3,000 7 months ago and due to our extremely cold winter and some flooding issues, the fence was not able to be installed until June. Our total cost was over $6700 due to some changes in height that we wanted. It took them about 8 hours to complete the job, however, it was not pointed out to us that we would have to do any work ourselves UNTIL the job was finished and the owner said that in 4 days, I could fill in the holes and haul the dirt away. I mentioned this to my husband that evening and we got out our contract which on the back there was an option that was not checked that they would clean up or fill the holes. We feel that this was not properly explained to us and that they sneakily passed it by us, due to the fact that he never mentioned ANYTHING about this prior to the job being completed and we had been in contact with him on many occasions prior to the work being done. All of the information regarding the fence, size, cost, posts, sections, gates, etc...and where we signed off on the contract was all on the front page.
My husband did reach out to him and tell him we were not happy about this and that one of the sections seems lower than the others and he said that he was 12 weeks behind on his jobs and that if we had wanted them to fill the holes and pick up the dirt it would have cost another day of labor. He said he would try to send someone out. No one has come out yet. Since he never mentioned that we would have to finish their job when we signed the contract, we did not know or otherwise we may have paid extra for it. Now it's been 8 days and they haven't sent anyone out yet and I took off work yesterday to try and fill as many holes as I could but we had rain last week so now all of the dirt is muddy and killing the grass. We are trying to finish and quot;their workand quot; as quickly as possible so our grass doesn't die. For the amount of money we paid it is ridiculous that we would have to finish the job. Not Happy!!!!
"The clean up is clearly stated in every contract we give our customers. Attached below. It is not lengthy nor small and hard to read. I have never had a complaint about this dirt issue. On the contrary to her critique the price paid is the lowest she can find around the Mahoning area and on the day of installation she was fully satisfied and had no complaints about the fence. She also stated to one of my workers that "she wasn't sure what to do with the dirt plies and maybe she could plant flowers in them to make them look better". She never inquired us to move the dirt. I have been in business for 31 years and have never had a complaint, especially about the dirt. I have an A+ rating with the better business bureau for 31 years as well. The post that sunk was due to the wetness of the yard. They planned on bringing in dirt and building a new drain system even before the fence was put up because their yard holds to much water. They had seven months (due to weather) to perform this before I completed my job. The post will certainly be fixed when the ground is not so wet and can hold the concrete. Thank You, Brian Sturgeon"
