I called a few dust control companies to get a quote for oiling my road and they all quoted me over the phone their costing and services. Both companies quoted the same price and both said that they applied two coats for that money, once you hired them and the second coat later around August or September. Then I received a invoice from them (Lyman) in May, before I hired their service, so I called and let them know that I wasn't going to pay for something I did not get and I was going to use someone else. The other company failed to show up and I desided to use Lyman dust control after all. A period went by after they applied the first coat around 7/8/14 so I called later to remind them that I was never billed. I received a bill late in the season sometime late October / November. I called the owner to ask why the bill was for the whole amount when they had only oiled the road once. The agreement was that they would oil the road two times for the amount of $1.25 per on ft of roadway. I had them do 400 ln. Ft. He said that they had applied the required amount of product and it didn't matter if it was once or twice, he still wanted paid for the whole amount. He said that I never called them to do it the 2nd time, but I informed him that I was never billed or told that I had to call them, I thought that they would apply the 2nd coat when they were in the area at their convience. If I had known I would have called. I told the owner that I would be willing to pay half since I got 1/2 the job completed. He said that they warranteed the job until the end of September and that the season was over and I could not get a second application. Since I recieved their invoice, a copy of the first one, after the season was over I think I don't owe more than half. I tried to reason with him that if I had hired a painter and if that they only applied one of two coats that I would consider the job not complete and would not pay until the second coat was applied. Mr. Lyman said that if the amount of paint covered the wall that the job would be complete one or two coats does not matter, even if that was the agreement. He also stated that he has recieved this type of phone calls before and had to explain this to others, if this is true why wouldn't he make sure that the customer understands the terms of the contract (oral) to avoid this misunderstanding. I feel that he was vague whether intended or not as it gives him wiggle room to fit his needs to have an excuse. The company has sent the balance to a collection agency without trying to come to some type of agreement.
