concrete repair, landscaping, mulch

Saturday, April 20th – Kevin of Onsite Construction Services came to my property to review the job and provide an estimate. I live in a 1500 sq duplex, so it’s not a lot of yardage. The scope of work was to: 1. Remove the rock in the landscaping 2. Grade the land around the house so it slopes properly - away from the property 3. Remove several small shrubs 4. Plant 8 perennials that I purchased 5. Replace the rock with mulch 6. Put a new concrete patio 16 x 12 over the current patio that is no longer leveled (see #2) Estimated time to complete job, according to Kevin: 2 to 3 days From Tuesday, May 28 to Thursday, June 13 – Kevin worked on site a total of 3 partial days. One day alone, two days with his teenaged son. I was patient through messages that: - his trucks were broken down - he couldn't get his equipment to my site or crew there as a result - the IRS froze his bank account - the truck repair took longer than expected All of this AFTER I had given him a $1000 deposit, made out to HIM as he requested, which he and his wife subsequently signed and cashed on June 4th. From Saturday, June 8 to Thursday, June 13, Kevin gave me 5 different times that were supposedly scheduled for my patio concrete pour. Each time, it was a no show and the first 4 times he had some excuse as to why a scheduled pour didn't happen. 1st time -Saturday 8:30am - He called at 7:30am to say the company he was using didn't pour because they didn't have enough concrete orders to pour on a Saturday 2nd time - Monday - He cancelled it thinking the weather was going to be bad, he wished he hadn't canceled. 3rd & 4th times - Tuesday 10am - i received no call. I called Kevin several times and heard back around 12:10pm. He said he had moved my pour from 10 to 12:30. I said no one is here. He acted surprised that his crew wasn't there setting up the form. 5th time - Thursday - Another 100% promise that it would be done. I left a message Wednesday to confirm the time. No response. No show on Thursday and no response at all since them. He's since removed his company from Thumbtack, which is the service I used to find and hire him. Not one aspect of this job has been completed. My yard is in worse shape now than it was when he started. He left debris, landscaping cloth, pulled out shrubs, and bags of product laying around my home. Most of the stone has been removed so now I have barren soil left to dry out around the new perennials that were planted. I have two tire burn marks in my lawn from where he used his truck to pull out shrubs – in wet grass. And, I have two large patches of Mahogany and Ebony stain on my back patio that he poured to show me color options to go on the new patio that was never poured. My yard is an eye sore. Here is the chronology of events if you care to have more detail. May 20th 22:27pm text with Kevin of Onsite Construction and confirmed his start date for Tuesday, May 28, 2019. Work would be completed that week. Tuesday, May 28, 2019 – Kevin messaged to say due to rain he was one day behind schedule and he would start on Wednesday. He said he would come by in the afternoon with paperwork for the job. We rescheduled for them to start at 8am on Wednesday, May 29th. He did not show to handle paperwork. Wednesday, May 29, 2019 – I text Kevin ay 6:57am to confirm start. He messaged that he would be late, and they would start at 9:00 am. He said he was having trouble with his truck. He was still coming. At 9:01am he notified me that the truck was being towed to his shop. 12:18pm – I text Kevin that I was home from a meeting I had in the morning. Thursday, May 30, 2019 6:33am Kevin moved the start back due to the rain. He was coming around 9am 9:01am – one of his trucks was being towed 9:38am He was stuck in traffic He arrived with his son Ian. They worked until about 4:30 – 5pm Friday, May 31, 2019 – 7:19am - Kevin sent text saying he would arrive at 9:15am. No Show. Kevin said he had truck problems and said he was trying to rent a truck to get to my site. Saturday, June 1, 2019 – I sent Kevin a text asking if his crew would be working today? No response Monday, June, 3, 2019 @7:32am - Kevin notified me that he “just got his phone back” and his truck would be in the shop but he was planning on having a crew to my place on Tuesday to complete landscaping and “forming the patio.” He apologized for poor communication over the weekend. 7:09pm – Kevin sent text saying his truck would be reay at 10am on Tuesday, so it would be a late start. Tuesday, June 4, 2019 – I sent text at 1:14 pm saying “Please tell me your crew is on the way here.” Wednesday, June 5, 2019 – I sent another text saying, “Kevin, I need to know what’s going on with my job.” Between 10 am and 1:20pm, I sent a series of messages via Thumbtack telling Kevin I was very concerned that I’d given him $1000 deposit and had about $150 worth of work completed. @ 2:11 pm I received a Thumbtack message from Kevin saying Ruben was on his way to my home to do the landscaping. No one showed and no one called to say what happened. Thursday, June 6, 2019 – @7:29 am I messaged Kevin to ask what happened to Ruben and why didn’t someone call me to tell me what was going on? He didn’t know what happened to Ruben, he was calling him to find out. Kevin said he would be there himself at 8am. Then it was moved to 9am. Another Thumbtack message, “It will be closer to 10.” I wrote back that we were off to another bad start today. He messaged back, “We will be finished by Saturday morning 100% for sure.” He arrived and worked alone. Kevin said my job would be completed on Saturday. I was scheduled for a concrete pour at 8:30 on Saturday. I ask what the completion plan was. Kevin said he would have a full crew working on Friday. The pour would happen on Saturday and the concrete needed to set for 3 hours. During that time the crew would finish the landscaping. Friday – June 7, 2019 – Late start – Kevin came with his son Ian but said a crew was coming later. He confirmed that I was scheduled for concrete pour of back patio for Saturday at 8:30am. He said he hired three additional workers for the pour. Informed me that the pour needed to sit for 3 hours and during that time, he would have them complete the landscaping so he made good use of the time he was paying to be onsite. Saturday - June 8, 2019 –@7:30 AM - I was in Panara Bread ordering coffee and bagels for Kevin and a crew totaling 5 when he called to tell me there was a problem. His concrete pour was cancelled because his supplier didn’t have enough concrete order to justify a Saturday pour. He was checking with another vendor, but there could be a $2000 fee for a Saturday pour. My pour was rescheduled for Monday. Monday, June 10, 2019, 11:15 AM I called Kevin. He asked if I’d received his text from that morning. I had not. He then realized he hadn’t sent it. He said he probably should NOT have cancelled the pour for that morning because the weather looked to be clearing up. The weather report was clear that it was going to be a good day. He said he rescheduled it for 10am Tuesday. Tuesday, June 11, 2019 – 9:06am – I called Kevin to confirm today’s schedule – No answer. I sent another Thumbtack message I received no response from the phone message or the Thumbtack message. Tuesday, June 11, 2019 11:36 am – left another messaging saying that I would continue to call so I could find out what is going on. And I’d appreciate a telephone call back. I received a text that read, “Can I call you back in 20 minutes?” I responded, “Talk with you in 20.” Kevin called. I asked why there was no crew here pouring concrete? He acted surprised and said, “They aren’t there!?” He said he had cancelled the 10am scheduled pour and moved it to 12:00noon – so the crew should be there now getting ready. I said, you never told me the 10am pour was cancelled. At this point, I told Kevin I was now convinced that he had no intention of completing this job and I was going to file a complaint with whatever agency I could and complete the Thumbtack review. He asked me to please not do that because he didn’t want bad reviews out! He asked me to give him time to make a phone call. A few minutes later I received a text that read, “Why the **** are you not at Glenwood. Call me.” I messaged back, “Kevin, this is Dr. Lisa. He text back, “I am sorry, I thought I was texting hector’s phone.” He called me back to say: I I know you aren’t going to be happy but I have rescheduled your pour for Thursday. I need the time to get my guys together. But we will be there Thursday to get your patio done. He said he would likely be at my place alone on Wednesday to plant two of the shrubs he’d pulled out that were to get planted somewhere else in my yard. I told him I’d be traveling on Thursday. He said I didn’t need to be there for them to get the work done. Wednesday, June 12, 2019 – I sent Kevin a text asking what time I should expect him. I received no communication from Kevin. Thursday, June 13, 2019 – I sent a Thumbtack message asking about the status of the pour for that day. This was the 5th time Kevin told me there was a concrete pour scheduled for my property, I also left him a voice message. I arrived home that evening and absolutely nothing has been done on my property. I am beyond disappointed and now I need a dependable, capable contractor to complete this job. Today, our HOA developer moved several of the shrubs to prevent the grass underneath from dying. Kevin O'Hare pulled them out and simply left them laying in various places in my yard. I have photographs of everything mentioned, including Mr. O'Hare and one of his company trucks.
