First missed commitment was to start the job June 13th. Chris committed to have the job completed by June 30th. After several weeks of repeated requests to start the job, Chris arrived on June 28th for a brief time to trench and install the gas line to the fire pit and cap off the sprinkler heads where the pad was to be installed. A total of (9 previous requests) to cap off the sprinklers where the concrete pad was to be installed were made to Chris. There was no supervision on-site overseeing the form install and concrete pad installation by sub-contractor that same day. The next day, June 29th in the AM, we notified Chris that water was flooding from under the newly laid concrete pad into the street. Chris showed up on the job site that afternoon, and said there was no water under the concrete and the integrity of the concrete had not been compromised. Chris was contacted and notified the following day that workers again did not show up on the job. We were informed by the subcontractor that he would not be coming to remove forms or apply sealing to the concrete as he had not been paid by Chris. We paid the sub-contractor to finish the sealing job. FINAL ANALYSIS AND SUMMARY: In good faith, we paid CP LANDSCAPING one half deposit for work to be performed, in the timeline specified and agreed to, for work to be completed per the contract. On several occasions between 6/2-6/30, we attempted to reach CP (by text, phone calls, and e-mails), each documented, to come out and do the work. He either did not respond, delayed his response, missed his commitment, or did not show up at all. When he did show up, which was 5 times, it was only for about 15 minutes, and two times to collect a check. He left his concrete sub-contractor unsupervised and without instruction. He also did not pay his sub-contractor, leaving us to pay him directly to complete the job. The concrete pad installation was deemed defective by three separate professional concrete company assessments, due to an uncapped sprinkler that caused water flow under concrete pad, softening the structure. There were voids, pits, and cracks due to insufficient release agent used. Color was added only to the surface, not throughout the whole pad. Base rock, compacting, or Rebar were not used also causing weakness to the construction integrity. CP installed an "interior" rated gas line. This was deemed ILLEGAL, and did not meet code by the city building inspector We gave CP Landscaping every opportunity to make the situation right and to correct the problems, but he did not do so. Finally, on 7/5, after all of this frustration, stress, time, and money we were left no choice but to terminate the contract with CP Landscaping. We requested our deposit money back. This put us in a position to have to go elsewhere to get the landscaping and concrete pad removed, done correctly, and to meet code. On August 3rd, on the day he was served court papers, Chris Price called us and agreed to pay the amount requested, but to date we have not received the funds. On September 26, 2017, a transcript of Judgement was issued against CP Landscaping by the County Court to pay the balance of the Judgement to date. CP Landscaping did not appear in court as per the NOTICE, CLAIM AND SUMMONS TO APPEAR FOR TRIAL served to him on 8/3/2017.
Description of Work: A landscaping contract was signed with Chris Price, the owner of CP Landscaping on June 2, 2017, to start concrete/landscaping services that consisted of the following: - stamped, colored concrete pad with a walkway. Trench and add gas line, add custom rock fire pit with lighting, relocate gate. Remove sod and old tree, add landscape timbers to level yard by adding dirt and top soil. Replace sod, add new tree. Chris was paid for one half the job as per the contract, by June 9, 2017. Chris notified us at that time that the materials and his workers "were ready to start".
