This was a really terrible experience, we bought a coupon from LEAHY PAINTING AND CONSTRUCTION at a charity auction for the STEPHEN SCHOOL for $500.00 and we had the company that donated the work in and they bid over $5000 and deducted $500. We felt that since the were GOOD GUYS and had donated to the school - that they would be great. The work was terrible, they quit the job unfinished and said they would not return because our expectations of a "Workmanlike manner according to standards of the industry " as per their contract were to high.
Description of Work: Leahy was hired to paint interior of our house-They Bid the job- and we accepted- they started the job, did a terrible job prepping for paint, and painted over nails and tape and outlets and on the fixtures. We were very concerned as the paint was peeling off of the woodwork, We requested that they finish the job under the guidance of a representative of the paint manufactures who was so great to come to the house and review the problems and tell them how to fix it so that the paint would stick to the woodwork and look nice- The representatives told us that it was one of the worst jobs they had ever seen.BUT tried to train them as to how to use their products to fix the fact that the paint was peeling off the wood. and also what they had to do in regards finishing the job in a professional manner. (like not painting over the light fixtures, and curtain rods and removing nails and debris BEFORE they apply the paint. They did one room very close to correct and when asked to finish the rest of the house and to address some of the concerns/bullet points regarding touch up and completion according the contract "IN A WORKMANLIKE MANOR ACCORDING TO STANDARDS OF THE INDUSTRY" they said OK -so we could be done and pay they their final payment. They finally said they would not finish the job at all and that we had somehow breached the contract by expecting quality work. We tried over and over to get them back to repair the problems they created and finish in a workman like manor - they refused to finish and they canceled an additional scheduled meeting with the paint manufacturer rep at the house . They said they would NOT FINISH> Now we have spent $5000.00 and the job is horrid- they will not finish and we will have to pay to have their bad work sanded off or somehow stripped down to be able to repaint the trim, SEPT 8 2011. Leahys Aug 10th letter to finish the work was never honored- AS of today,Sept 8,2011 the LEAHY Painting and contracting company has NEVER returned to finish the job. Has missed meetings with us and the Paint Supplier to resolve the issue. After a month of having our furniture in storage and the children staying at relatives while the job is completed, we have been forced to hire another painting contractor and will be spending a minimum of $10,000 to strip,repair and continue to finish the paint job including the repair of the cracks in the plaster in the ceiling and to repaint. This is much more costly as the work that was performed by Leahy needed to be removed with chemical strippers or sanded off by hand to get back to the wood for proper adherence to the millwork. In a letter sent today by registered mail from RYAN HADLOCK ,with this request in writing -(in addition to our past email requests and letters) "Leahys:I have been informed by two reputable painting subcontractors that it will cost a minimum of $10,000.00 to repair the poor painting workmanship performed on my house by you and your employees. I have also consulted an attorney and am considering filing a suit against your construction bond and your company. I am also prepared to take steps to inform other people about my unpleasant experience with your company so that they do not have a similar bad experience. However, before I do that, I am going to make a settlement demand to you. In exchange for payment by you to me in the amount of $4,000.00, I am willing to enter into a mutual release of all claims and we can each go our own way. This money does not compensate me for my loss but it does ease the financial burden you have brought upon our family. This demand is open until Friday, September 16, 2011 at which time it will expire. "

So let’s get down to your Angie's List complaint TO SEE IF THERE IS A RESOLUTION IN SIGHT. ADD UP THE TRUE STATEMENTS (RESOLUTION IN FAVOR FOR YOUR MEMBER) AND THEN ADD UP THE FALSE STATEMENTS (RESOLUTION IN FAVOR FOR THE CONTRACTOR), AND YOU DO THE MATH. ALL STATEMENTS BELOW COME WITH COMPLETE DOCUMENTATION FOR ACCURACY. 1) “Leahy was hired to paint interior of our house-They Bid the job- and we accepted- they started the job” TRUE 2) “did a terrible job prepping for paint” FALSE – if the prep work was so “terrible” why did you not say something and then why did you pay the second installment? Makes no sense at all. 3) “painted over nails and tape and outlets and on the fixtures” TRUE and FALSE Some customers ask us to paint over nails that are secured in a stud board so that they don’t have to go around and find the studs again to hang their picture(s) from. So yes we did paint over some studded nails – we also said that if they wanted them out it was a simple fix being that the walls were done in a flat paint – very easy (this was in ONE area) Tape and outlets on the fixtures – I’m not even sure I know what this is all about – you never showed me any of this so it is FALSE. 4) “We were very concerned as the paint was peeling off of the woodwork” TRUE Paint Co. addressed issue and suggested another material to solve problem we bought this out of our own pockets no charge to customer. 5) “We requested that they finish the job under the guidance of a representative of the paint manufactures who was so great to come to the house and review the problems and tell them how to fix it so that the paint would stick to the woodwork and look nice-“ FALSE Yes, the Paint Co. was called and the representative said that this was an issue between Contactor and Customer – you got mad over this and your Mother called down to San Francisco, California and reported him to corporate office – they then said to send someone out to the customer. The representative (two of them) came out inspected for poor quality of MATERIAL ONLY – not the workmanship. The representative suggested that the Contractor use Kel-Bond to adhere to the trim. It was agreed that we would do one room (at the customer’s choice) to finish in completion and have the representative come back in and inspect the work. All were in agreement and the representative PASSED ALL THE WORK. You were still satisfied with that! 6) “The representative told us that is was one of the worst jobs they had ever seen. BUT tried to train them as to how to use their products to fix the fact that the paint was peeling off the wood. and also what they had to do inregards (sic) finishing the job in a professional manner. (like not painting over light fixtures, and curtain (sic) rods and removing nails and debris BEFORE they apply the paint.” FALSE Within the last 30 minutes I have just read this entire statement to the representative who came out for the meeting and came back out and inspected the final work and he stated, “I NEVER SAID THAT OR ANYTHING LIKE THOSE WORDS AT ALL” (direct quote) He went on to say, “THAT STATEMENT IS TOTALLY FALSE.” 7) “They did one room very close to correct and when asked to finish the rest of the house and to address some of the concerns/bullet points regarding touch up and completion according the contract “IN A WORKMANLIKE MANNOR (sic) ACCORDING TO STANDARDS OF THE INDUSTRY” they said OK” TRUE AND FALSE We have film coverage of all of this – taking no chances that the MEMBER would pull something like what they are doing. The representative came out and passed everything, although there were as few as three small areas (size of a dime) that needed to be touched up where in cutting in the edges it got onto the wall. The walls again were in a flat paint and the time it will take to fix this is less then 10 minutes. 8) “so we could be done and pay they their final payment.” FALSE You ignored more than 15+ emails requesting whether you would honor the original contract for final payment – just a plain flat “YES” would have sufficed but you wouldn’t even do that. That led us to believe that you had all intentions of NOT PAYING US THE FINAL PAYMENT. 9) “They finally said they would not finish the job at all and that we had somehow breached the contract by expecting quality work.” FALSE You never honored with a response to any of our emails, phone calls or registered letter(s) regarding final payment and SO YOU, MEMBER, BROKE THIS CONTRACT. WE HAVE YOUR SIGNATURE FOR RECEIPT FROM REGISTER MAIL TO YOU REGARDING THIS ISSUE – DO YOU??? 10) “we tried over and over to get them back to repair the problems they created and finish in a workman like manor (sic)” FALSE Who tried “over and over” again - - NOT YOU – WE DID! Yahoo emails showing our proof of “over and over” again. Do YOU? We also have phone call records plus registered letter(s) signed and dated, do YOU? 11) “they refuse to finish and they canceled an additional scheduled meeting with the paint manufacturer rep at the house. They said they would NOT FINISH” FALSE We clearly wrote them (and they must have read the emails because how else would they have known) stating that we accept their breakage of the contract and so there is no need for a meeting with Paint Co. Paint Company had already declined their request for this meeting. 12) “Now we have spent $5000.00 and the job is horrid” FALSE If the job was that “horrid” why did you pay the second installment? WHY??? All the walls and ceiling were completed, passed by you, and your mother, and your father, and then paid for and now you say they are “horrid” MAKES NO SENSE. 13) “they will not finish and we will have to pay to have their bad work sanded off or somehow stripped down to be able to repaint the trim.” FALSE Paint Co. heard this statement and commented that the MEMBER’s ask for paint from their company, AT COST, in order to finish the job THEMSELVES. Paint Co. said they would not give them the paint at cost BUT would give them a discount (just to settle this mess). So NOW they are saying that they have to get someone in to finish the job costing 10,000 FOR WHAT??? TRIM???? So, are you doing it yourself or having a “subcontractor” do it? LIES! LIES! LIES! ALL THE WAY AROUND (to us, to other contractors, to the Paint Co. representatives. etc. etc.). 14) “the children staying at relatives while the job is completed.” Did you forget to mention to Angie's List that you held up the start of the job by days while you battled it out with your previous General Contractor, And because we were held up late YOU ASK US FOR COMPENSATION FOR BOARDING YOU WIFE AND CHILDREN UP IN A HOTEL FOR THE TIME WE HAVE TO FINISH, when it wasn’t even our fault just because we were the last company on the job site. There’s a lot of factual accounts that you left out when you reported us to Angie's List - isn’t there member?????? There’s a lot o LIES that you left out when you reported us to Angie's List - - isn’t there member?????? You can scramble now and make up pictures and damage things but at the end of the day we have the documented truth on our side. So let’s all do the math here: **Pictures/film of the finished work don’t lie. **Emails don’t lie, **Phone messages (from you) don’t lie, **3rd party witnesses don’t lie **Contracts signed by both parties don’t lie Hmmm…….. There’s a lot that Angie's List doesn’t know….. You know there should be a website for “BAD” customers!!!! RESPONSE TO FALSE COMPLAINT 1) You have gone through 4 Contractors on this one job, none of them made you happy, according to your own words, and you fired or reported them all - - - - WOW! (Had we known ahead of time we would have avoided this job totally); 2) We have given you enormous amount of “FREEBIES” not originally in the contact just to keep you happy (documented by you, member, through your statements in several emails); 3) We worked around the clock (documented by you on a phone message & emails) to meet your deadline (including Saturday’s and Sunday’s) just to please you; 4) We completed and FINISHED 90% of the job - - all walls and ceiling done without any complaints from you and then you PAID US up to that point!! (If you found to work unacceptable – WHY DID YOU PAY US?); 5) With ONLY SOME TRIM left to do, you claim that it will cost you an additional $10,000 worth of work to do? 6) Why would you pay for everything but the last bit of trim if you thought the work was “horrid”, UNLESS you were trying to get out of paying the last payment to us? Did you run out of money? You did stat on several occasions that your mother and father were paying on the contract because you and your wife didn’t have it. Is this what happened in the end and now you take it out on us through defamation? After all, you are demanding/threatening for us to reimburse you for the entire job, so something went wrong here with the money situation. 7) We have PHOTOS of the entire finished site (you, personally, saw us taking the film), 3rd PARTY WITNESSES (signed and notarized). POHNE CALLS (75+), and lets not forget the 60+ EMAILS that you sent all within two weeks time! 8) The CONSTANT THREATENING by you, to us, through phone messages and emails (as late as 9/27/11 – last night) has got to cease. We have chosen to explain our side with truthful, documented, facts thus taking the honorable high road, without resorting to threatening behavior, phone calls, or emails. I have been in business for 25 years with a flawless record. I have never been sued, threatened or had to have anyone, outside of the individual customer, inspect my work for accuracy. If I was as “BAD” as you $ your mother, complain that I am, then WHY haven’t I had any complaints on my records? As I have stated before in several emails - YOU BROKE THIS CONTRACT NOT US, by refusing to acknowledgement to pay us the final payment for finishing the trim and punch list. Specks of the contract: 1) Dining room ceiling and walls painted and finished coated; 2) Living room ceiling and walls painted and finished coated; 3) Entryway area ceiling and walls painted and finished coated; 4) Stairway walls painted and finished coated; 5) Hallway area ceiling and walls painted and finished coated; (plans to give another “floating” to the ceiling to please customer) 6) Playroom/son’s room painted and finished coated. (Areas 1-6 ALL OF THESE COMPLETED – YOU PERSONALLY PASSED, AND THEN PAID) 7) TRIM – only in some areas left to do and a small punch-list. (NOT COMPLETED – NOT PAID) STOP all this anger! We purposely took film coverage of all of the work and finished work (so you can’t claim damage after we left), we have witness and their statements, along with your endless 75+ phone calls in a scope of two weeks (some of them still on the answering machine – and some angry/threatening ones too!), and 60+ emails (that all generated from you), also, in a scope of two weeks. So to go as far as to say we “damaged” your house that is definitely a LIE! The original condition of you house when we first came on site was deplorable and filthy at best. Remember, we had to wash you windows for the tape to even stick on them, they were that bad with black dirt and grease. So to blame us for the damages caused to your house that is FALSE. No, at the end-of-the-day you will still be a very unhappy many, who is angry with everyone, and just wants to get something for nothing, because you ran out of money.
