Floor Accents removed our old floors and installed the new wood floors. when they started we were concerned that the wood was matching and they said wait until the sanding and finish was done as it would match. Once they completed the finishes it was obvious the floors were drastically different and clearly were a lesser grade of very cheap wood. Marco Orsini (Reg. Agent for the company) met us on site within the 30 days period after install and we told him the grades, species, etc... were wrong and we were not satisfied. Marco asked if he could sand down some sample areas and try to restain the sample areas to match. We allowed them to do so and there was no difference - very drastically different floors. They then said they would refinish and "weather" out all of our old floors and apply a dark stain to get their new floors closer to matching which we did not want.
They said if they refinished all of our existing floors and their new floors and were still not satisfied that we would still owe them the difference and we would be stuck with it. Also that they would lien our home for the balance whether we liked it or not. We did not want black/dark stained wood. We liked our light colored natural wood that was existing so we declined his offer. The options Floor Accents was offering were not reasonable so they offered to just refund our money and we could hire someone else. Floor Accents finally agreed they ordered the wrong floors by mistake and they shouldn't have been installed! They agreed they would not want these floors in their own home!
We accepted Floor Accent's offer to refund our money as the their new floors were a horrible "match" to the existing abutting floors. Several months passed without payment-July, August, September 2014 - finally Marco Orsini/Floor Accents said they wanted the bad floors removed, boxed up and returned to them (and cleaned up, nails and stain removed) before they would refund us. This is ridiculous and NOT physically possible. Then he said we had to pay for the new subfloors and he would refund the rest. The subfloors were not in good condition and finally they said they would remove the floors completely and refund us the money prior to removing their bad materials from the property.
We agreed but then a few days before we were to get the refund Floor Accents came up with an agreement saying we COULD NOT DISCUSS THIS WHOLE INCIDENT WITH FAMILY, FRIENDS, NEIGHBORS, ANY MEDIA AND HAD TO REMOVE ANY FACEBOOK OR PUBLIC REVIEWS COMPLETELY AND COULD NEVER DISCUSS THIS OR SHARE THE INCIDENT OR THEY WOULD SUE US AND LIEN OUR HOME! We refused as this was not in our control and many people had already seen the catastrophic floors. The basically required a complete GAG ORDER including taking our rights as American Citizens away! We could have cared less about him or his company -we just wanted the refund (which was promised IN WRITING atleast 9 different occasions). We agreed they could have all of the floors back in return for the refund as PROMISED by Marco Orsini /Floor Accents.
The day of the removal and when the old materials were in the front yard ready to be loaded I met Marco Orsini at a local bank to get the refund and he refused the refund until I signed the GAG ORDER - new one he hired attorneys to write. This form was not just a "quit claim" agreement saying we agreed to refund and were done. This form went further taking away our past and future rights to any type of review by anyone which I refused to sign as it was ludicrous. When I returned home his installers had removed the material in my absence and we were left with a torn up home, no floors and no money at all. They TOOK OUR MONEY, OUR OLD FLOORS AND THE NEW (BAD) FLOORING AND WE HAVE NOTHING BUT TORN UP CONCRETE!!!! The installers told us they had done this to other customers as well!
The next business day I filed a small claims suit after requesting and demanding the refund many times. Floor Accents hired 4 different attorneys and 2 different law firms to oppose me and my family in court. They were able to drag out the court process with their attorneys for almost 2 years overall - finally we received a court judgement for the refund amount. Floor Accents then was able to convince the court the names on the judgement were wrong - even though we used the name on their ownPurchase Order! the court eventually agreed and we had to refile which we did and recently have rewon the judgement for the refund. Floor Accents even tried to sue us for their legal fees which are about TWICE the refund amount. Floor Accents and their Agent of Record carry many different aliases and business names. Even a court member said this was clearly a case of fraud.
Once the 2nd judgement cleared we have not been able to get floor accents nor Marco Orsini, the Registered Agent to answer any phone calls or emails and they even refuse certified mail. ALL WE EVER WANTED WAS THE REFUND PROMISED TO US SO WE COULD HAVE THE FLOORS REPLACED AND WE ONLY GET IGNORED. THEY HAVE OUR MONEY AND FLOORS!!!!
We are still awaiting any kind of payment from Accent Floors or even any correspondence. The day before the last court date they also tried to extend the court date again. Floor Accents nor Marco Orsini or ANY rep from Floor Accents even showed up on the last court date so am not even sure if they are in business although they keep advertising. Note I have seen several "reviews" on websites written by their own relative!!! We even agreed to sign anything to get the refund and now they say they don't have enough money! It's less than $5,000.00!!! and they are still in business!!?
We had to have the floors repaired so have had to buy the floors again. the last flooring company located here in Flower Mound came in, installed new floors next to our existing floors and the difference cannot be seen - we are extremely pleased with the new flooring company, their installation and the new floors - PROVING this could be done.
Consumer beware! They stole our money and left us with nothing and could care less! We just want what is fair and what they agreed to.
Then we found out from the subcontractors he was not paying them so we told him we would not pay him any more money until he paid them. He also collected about 60% up front because he said he had to pay the cabinet company up front. Well I am writing this now because we just found out the cabinet company put a lien on our house. He owes them $7K and never paid it.
I would stay clear of this company as they deal this way by now paying their sub contractors and also not finishing the job. He never came back to do a final walk thru and we had a lot of outstanding issues including that they did not install our fridge water line so water flooded under our new tile floor and down our hallway under our wood floors into our son's carpeted room. When we told them, they said things like this happen all the time so pretty much too bad.
I also want to share some knowledge I learned the hard way which is only give a contractor half the money and don't pay until you know all the subcontractors have been paid. You can also ask for all the subcontractors to sign a no lien agreement or write the checks to them directly.
My step mother is a lawyer and she said this is typical of contractors and you can take them to court but they just close down their company and open another under a different name. I am sure there a lot of good and trustworthy contractors but Floor Accents is not one of them.
