My wife and I entered into a Fixed price contract with Matthew Avery of Avery Construction LLC to build our dream home. Mr. Avery is very good at selling himself and his companies to acquire your business but not at delivering. Throughout the building process of our home there were weeks at times of no sub contractors on the job site, then at times different sub contractors all in the house at the same time causing disorganization on the job site. We were even getting complaints by some of the sub contractors about the lack of job management by Mr. Avery. As we neared the end of construction Mr. Avery informs us that he will need approx 62k to finish the home while my wife was in the hospital after having our second child. Keep in mind this is a Fixed Price Contract, and we had already settled up on things we were informed of being over budget on by paying out of pocket for our septic system and appliances while allowing Avery to obtain the draws for these things and use them as credits towards our overage. We found out shortly after his demand for more money on our fixed price contract that it wasn't just a few suppliers who did not get paid, but multiple suppliers being owed over 60K. The unpaid bills date all the way back to the foundation work. He had signed affidavits with the bank along the building process stating that amounts owed had been paid in full. He then placed a false lien on our home which included amounts for things such as payment for the lot which he never owned, a near 5K miscalculation in the amount he had been paid to date, credits for being under budget when he left our home incomplete, and payments for work never done. One of the areas he charged us with being over budget was on insulation. Avery used his own spray foam company to provide the insulation and Avery was the one who provided the estimate for the job. We had filed a counter suit against his company and a motion to expunge his false lien; however, Avery Construction filed bankruptcy and he has now reinstated a previous LLC and renamed it Centerline Construction. This is at least the third name he has used for his construction company. He also did all the plumbing on our home except for the plumbing in our slab and Mr. Avery is not a licensed plumber which is a requirement of the county our home was being built in. His unlicensed plumbing has left us with numerous problems in the home including a gas leak, a sewer gas leak, and three bathrooms that will need walls, or floor busted out and redone to repair the faulty plumbing. His gross negligence relating to the building of our home resulted in Matthew Avery losing his residential contractors license from the Mississippi State Board of Contractors. We also know we are not the first family to encounter problems with Matthew. My hope for providing this review is that people would be informed so another family does not go into business with him without knowing the facts of his business dealings. Matthew Avery is currently a owner/partner for Centerline Construction LLC and AirLock Insulation LLC.
