In summary, I could not have gone worse. From the time we had to leave our house to begin the renovation until the time we returned we had to start over at square 1 with a new contractor it was over three years, October of 2007 to January of 2011.
Description of Work: My now wife and I entered into a contract with Stabilt Construction for the reconstruction and renovation of our house during the 2007/2008 time frame. The contract provided for a fixed fee, and required substantial completion within a certain amount of time. The project was mired in delays and Stabilt failed to complete the work in a timely fashion. As a result, we terminated the contract about 1 year from commencement of the original project when it was only about half-way complete. We terminated the contract not just because of the significant delays, but because we learned that William Adamski, the owner of Stabilt, had not applied for a building permit and had misled us to believe that he had done so. We brought a variety of claims against Stabilt and Mr. Adamski in an arbitration proceeding. The arbitrator found that we were legally justified in terminating the contract on account of the delay, and awarded us damages for the delay and related expenses (e.g. rent, storage, insurance, etc.), defective work, over billing, interest, and attorneys’ fees. The arbitrator also found Stabilt’s counterclaims against us to be without merit. The arbitrator found that Mr. Adamski’s statements to us concerning the status of the building permit and the building permit process were misleading, whether he intended them to be or not.
