At first I thought I was with a professional outfit that comes under the REMax corporation. My listing was on the REMax website. After I signed the contract, I find that they were more interested in renting my house. The Remax sign did not go up in the front yard as I requested, but instead a and quot;Positive Propertyand quot; sign was displayed. During the 6 month contract, several incidents of vandalism occurred on the property. I took a job overseas and trusted Melissa Nailey to take care of the property.
I came back in March 2014 and found the following with my property: Two full grown trees were cut down, the fence had p*** graffiti on it, toilet clogged, kitchen disposal full of coffee grounds, downstairs bathroom plumbing problem, and the main bedroom ceiling fan falling down. Someone decided to pull the blades down. It looked like someone had been running the place as a day care center for juvenile delinquents. I counseled Melissa on her performance, and I repaired the items listed above. We did get a deal prior to expiration of contract, but Melissa failed to follow up on the appraisal. The appraisal was inaccurate and I pointed it out to her. New improvements of siding on the house, and new windows installed, made a big difference on the value. I told her to get it corrected with the appraiser, and she REFUSED. The buyer backed out of the deal, and I refused to renew the contract.
Melissa's last words to me on the phone were this: and quot;I can still rent it for you!and quot;. Goodbye! I would not recommend this outfit to my worst enemy. I hired them to SALE the house, not to rent it out.

"Mr. (member name removed) signed a listing contract with Positive Property to SELL his home. His contract stated the property was being listed with Positive Property. NEVER was it ever implied in writing or verbally that we had any association with REMAX. A FOR SALE sign was installed on his property and not for rent. Mr. Burton did not enter into a property management agreement with Positive Property Management. We were never asked to maintain the home in his absence. KU removed two trees from the property which were infested with emerald ash bores and had to be removed. He was notified before they were removed. This is documented. The fence was graffitied and he was immediately notified. This is documented. The who neighborhood had been defaced overnight. He was already back in town when this happened, and did not return to town to discover it. He was notified by our office it had occurred, and then went over to his house to inspect. Ms. Nalley was able to get the property under contract, however the contract had a full price appraisal in it. The home did not appraise for the purchase price. All Kentucky appraisers are licensed. The appraiser is selected by the purchasers lender and not by the seller, the seller's agent. We as the seller's agent are not allowed to contact the appraiser to induce him or her to change the appraisal. The appraiser inspects the property and takes pictures and is well aware of all improvements of the home and how or if they will be reflected in the appraisal value. Mr. Burton was informed of this information. ALL the claims made in this response are documented, from the contracts signed, services performed, notifications to owner of tree removal and graffiti, correspondence in regards to appraisal. And Ms. Nalley NEVER, EVER, EVER offerred to rent the home for Mr. Burton. After dealing with Mr. Burton in the sale of this property, we had ZERO desire to be in a continued business relationship with him. We have been nothing but professional in dealing with Mr. (member name removed), we cannot say that this was a reciprocal."
