"I was hired by the property manager to dry out the basement. We started the job on a Saturday. Once the tenant's moving company removed all the content the process went very smooth. The adjuster met the property manager on site and was in agreement with our process. On the last night of the job the basement re flooded and we had to extend our services a few more days. There was some debate between the owner and the property manager about who was responsible for the second flood. When the property manager sent the plumber out to replace the pump there was several inches of water in the basement. The new pump failed a few days later because debris clogged the propeller. The owner was not understanding of why the plumber did not clean out the pit. The owner was hoping the insurance company would cover the second flood under the claim but we communicated that this was two separate events and that he would be responsible for two deductibles. I've been doing this work a long time and have heard all kinds of horror stories from customers so I suggested to be careful submitting a second claim back to back because the insurance company could consider you high risk and drop him as a customer. I said this knowing that he had shingles missing from the roof (this was the "unsound advise" that we provided- we actually consider it wisdom to consider all the options before making a rash decision) We normally work directly with the insurance company to settle the claim and usually there is some negotiation involved. It was a couple weeks before we were able to submit the invoices for payment and we sent a copy of the invoices to the owner and the property manager. From there the owner dealt with the adjuster. I was able to make contact with the adjuster once she returned from vacation. As a part of the negotiations we settled by discounting our services by roughly $70. It is normal to negotiate a claim. Why did we mention a mechanics lien? The property manager paid the second flood in full while they discussed who was responsible and if the owner would submit a second claim. The delay was because the owner waited to submit the second claim. Meanwhile, when the first claim was paid directly to the owner, he took part of that money and paid the property manager for services leaving us outstanding for the larger portion of the claim. This was a red flag for us because we also knew the relationship between the owner and property manager was ending and the house was going on the market to be sold. As a contractor, if I feel that payment is being held and my recourse options are limited by the sale of the house then I have to protect our interest. Keep in mind we never asked for money up front to start the work as most companies do and we did not ask for any money on the last day of the job. This is a very unfortunate transaction, one that neither of us would want to repeat. We are in good standings with Angie's List as you can see. Sometimes it's just best to move on."
