I met with Kevin Kovtun and Ashley Cappiello on May 19th and gave them a check for $2,500 for them to come up with detailed plans and drawings to scale for my rear entry, patio and backyard. They stated that the design process would be collaborative and that they would be back to me with initial plans/ideas within 2 weeks. When I called after 2 weeks I was told by Ashley that they were "swamped". When I still did not hear from them by June 12th, I called their offices and told Ashley that I wanted to put the project on hold and wanted my money back. On June 14th I emailed Kevin Kovtun my request for my money back and on June 28th sent a certified letter to the business demanding the return of my money. Land Masters response (received via email) was that "the amount of time to formulate ideas, designs, sketches, and drawings far exceeds the retainer we received from you at this point." Given that I have received no services from Land Masters, I want my money back.
Description of Work: Was to design a rear entry with scale drawings in detail, create a master design for patio and backyard, and alter any design elements to agree with town planning and zoning standards.

Response from LAND MASTERS
Land Masters is hereby addressing the claim made against Land Masters by the member. She claims that our company did not fulfill our contract and turned a deaf ear to her "demands for a refund". However, in our opinion, that claim is clearly not based in fact. During the months (February to May) prior to this situation, Mr. Kovtun, our head designer, met and corresponded with the member. After several hours were invested, the member did sign a contract with us. The payment was received on May 19, 2007 and the contract was received on June 1, 2007. The work was completed by or around June 4, 2007. The member was notified that the designs were completed. While Mr. Kovtun was unavailable to meet with her for approximately ten days. During that time we offered to schedule an appointment for her and he did offer to meet with the member to review her designs promptly upon his return. Altogether, we attempted three times (6.14.07; 6.22.07; 7.2.07) to schedule an appointment with the member. She repeatedly ignored our offers to review the designs. Our means of sale is intellectual property. It cannot be returned. The work that the member requested was completed. Simply because she chose never to review the designs, does not mean that the work was not done nor does it entitle her to a refund.
