"My response to this complaint is as follows we did sign contracts on March 20, 2021, but did not receive the building permit from the town until November 2021. My contract was for an extension with a crawlspace foundation. I gave my customer the option to start in January or wait until the spring of 2022, they agreed for me to start in January 2022. The foundation was installed around January 15, 2022, and had to be hand dug and wheelbarrowed from the back of the house to the front and loaded on a truck of all the excess fill that had to be removed. It is true we had problems with the architect taking a long time to do the final drawings. Lisa advised me that she was going to cancel the contract because the plans were taking so long. I agreed to refund the deposit and cancel the contract. I spoke with the architect and he agreed he would take $1000 off for his fee if they did not cancel. We submitted the plans and got the approved plans and permits around the end of October 2021. I had my Mason meet me at the Jobsite in early December 2021 and that was the first time he was there. The problem with digging with the machine was initially we would be able to get it back there but because the property runs at an angle we would not be able to get the machine out after digging the basement. I informed the homeowners and told him at that time it would be an additional $10,000 to hand dig and remove of the fill. I received an email on December 26, 2021, from Lisa that she wanted an amendment to the original contract that would include all the extras as of that date, that we will hand dig and remove the fill for the crawlspace foundation and that it would be completed by May 1, 2022, as long as there was no supply issues or additional work that will extend the time. Lisa agreed to this and we signed an amended contract on January 15, 2022. After my customer tried getting her own prices for the foundation work she decided to go back to doing just the crawlspace which meant I had to have the architectural drawings changed for the town building permit and the architect for $850. There was an additional fee of $2800 that I paid my Mason contractor to hand dig and remove excess fill for the new crawlspace and foundation. The plumbing permit was not issued until May 9 of 2022. All our work was inspected by the town and approved such as foundation work, framing, electric, rough plumbing, siding, and insulation. The only work left on the job to be completed was plumbing fixtures to be installed, baseboard heat that my customer had me move three times, base trim, and a small punch list that I went over with them on June 20, 2022. I also found out that day they had someone else install my maple hardwood flooring and I explained to them I will not warranty the installation of the floor. T On June 21, 2022, I emailed over a final list of things to be completed and asked for final completion date of July 30, 2022. I had all the necessary approvals from the town and inspections and there still is a substantial balance due to my company. I try to satisfy all my customers and unfortunately had to turn this matter over to my attorney. Thank you for letting me respond to this complaint."
